Terms of Service

1. Definitions

"Service" means the Storybook Sanctum platform (formerly Storybook Sanctum), including the web application, APIs, and all related features accessible at our domain.

"We," "Us," "Our" refers to Storybook Sanctum and its operators.

"You," "User" refers to any individual who accesses or uses the Service.

"User Content" means any photographs, images, text, prompts, or other materials you upload or submit to the Service.

"Generated Content" means comic books, children's books, graphic novels, illustrations, stories, and other materials produced by the AI systems in response to your inputs.

"AI Systems" refers to third-party artificial intelligence services used by Storybook Sanctum, including Anthropic Claude (for text and story generation) and Google Gemini image generation models (for illustrations).

2. Eligibility and Account Requirements

You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Service, you represent and warrant that:

• You are legally capable of entering into a binding agreement
• Your use of the Service complies with all applicable laws in your jurisdiction
• You will not use the Service if prohibited by law from doing so

3. User Content — Your Responsibilities

3.1 Ownership and Rights

You retain ownership of any photographs or images you upload. By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of generating your comic.

You represent and warrant that:

• You own or have the necessary rights, permissions, and consents to upload any photographs you submit
• You have obtained the explicit consent of any identifiable individuals depicted in photographs you upload
• Uploading and processing your content does not violate any third party's intellectual property, privacy, publicity, or other rights
• You will not upload photographs of minors without explicit parental or guardian consent
• You will not upload photographs of public figures, celebrities, or other individuals for the purpose of creating misleading, defamatory, or exploitative content

3.2 Prohibited Content

You agree not to upload, submit, or prompt for content that:

• Depicts, sexualizes, or exploits minors in any way
• Is pornographic, sexually explicit, or obscene
• Promotes, glorifies, or incites violence, terrorism, or hatred against any group
• Harasses, threatens, or defames any individual
• Infringes any copyright, trademark, or other intellectual property right
• Impersonates or misrepresents your identity or affiliation with any person or organization
• Violates any applicable law or regulation
• Depicts real individuals in a false, misleading, or harmful context

4. Generated Content — Ownership and Limitations

4.1 Ownership of Generated Content

Subject to these Terms and your compliance with them, we assign to you any rights we may hold in the Generated Content produced specifically from your inputs. You may use Generated Content for personal or commercial purposes, subject to Section 4.2 below.

4.2 Commercial Use

Commercial use of Generated Content (including sale, licensing, or publication for profit) is permitted subject to the following conditions:

• You comply with the usage policies of Anthropic (anthropic.com/legal) and Google's Generative AI Prohibited Use Policy (policies.google.com/terms/generative-ai/use-policy)
• You do not represent Generated Content as having been created solely by a human without AI assistance in contexts where such disclosure is required
• You independently verify that Generated Content does not infringe third-party rights before commercial use

4.3 No Guarantee of Uniqueness or Non-Infringement

Due to the nature of AI training data and generation, Generated Content may:

• Bear similarity to existing copyrighted works
• Inadvertently reproduce elements protected by third-party intellectual property rights
• Be independently generated for other users with similar prompts

We disclaim all liability for any intellectual property claims arising from your use of Generated Content.

4.4 Content Moderation

We reserve the right to review, filter, or decline to generate content at our discretion. AI Systems may independently refuse certain requests based on their own safety policies, which are beyond our control. No refund is owed if content is declined by AI safety filters.

5. Payments and Refund Policy

5.1 Pricing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's Terms of Service in addition to ours. All prices are in USD and include applicable taxes where required.

5.2 Included Retries, and No Cash Refund for Completed Generations

Because generation consumes computational resources that cannot be recovered, we settle dissatisfaction with retries rather than cash refunds. Once generation begins, no cash refund will be issued for a completed generation, but your included retries remain available to you.

This policy exists because:

• API costs to Anthropic and Google are incurred the moment generation starts and cannot be recovered
• Each generation is a unique computational process created specifically for you
• You have the opportunity to review your story outline and character avatars before committing to full image generation

Retries are tied to the purchase that included them, expire with that session, and have no cash value. Video packages do not include retries, because the cost of producing video is substantially higher.

5.3 Exceptions — Technical and Fulfillment Failures

We will issue a credit or refund in the following circumstances:

• Generation fails completely due to a server error on our end before any images are produced
• Payment is processed but no generation session is granted
• A verified billing error results in a duplicate charge
• You purchase a physical printed book and the order is not successfully placed for production with our print partner, or is cancelled before production begins, due to an error on our end or our print partner's end

5.4 Printed Books and Physical Fulfillment

Printed books are produced and shipped by a third-party print-on-demand provider (Lulu Press, Inc.). When you order a printed book:

• Production and shipping timelines are determined by the print provider and are estimates, not guarantees
• Once a print order has entered production, it cannot be cancelled, modified, or refunded except where required by law, as the physical book is manufactured specifically for you
• We are not responsible for shipping carrier delays, lost packages, or address errors resulting from information you provided
• Print quality, color reproduction, and trim may vary within the print provider's standard tolerances; minor variation is not grounds for a refund

If a printed book arrives defective or materially different from what was ordered, contact us at [email protected] within 14 days of delivery and we will work with the print provider to arrange a reprint or appropriate remedy.

5.5 Chargebacks

Initiating a chargeback for a completed generation without first contacting us constitutes a material breach of these Terms. We reserve the right to dispute any chargeback and to permanently block access to the Service for users who abuse the chargeback process.

6. Our Intellectual Property

The Storybook Sanctum platform, including its software, interface, branding, and proprietary prompting systems, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• Photographs you upload are transmitted to our AI providers (Anthropic and Google) to analyze appearance and generate your book. We do not use your uploaded source photographs to train our own models.
• Generated Content (illustrations, covers, and completed books) and associated account and order records are stored on our infrastructure and third-party cloud services, including Cloudflare R2 (file and image storage) and Supabase (account, library, and order data), so that your books remain available to you and so we can fulfill orders and provide support.
• A copy of your generated books may also be cached in your browser's local storage on your device for offline access and faster loading; this local copy is separate from, and not a substitute for, the server-side copies described above.
• If you order a printed book, the name, email address, shipping address, and phone number you provide are transmitted to our print-on-demand provider (Lulu Press, Inc.) solely to manufacture and ship your order.
• Payment information is collected and processed entirely by Stripe and is never stored on our servers. Email notifications are sent via our email provider.
• We do not sell your personal data to third parties.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, quality, or suitability of Generated Content
• Warranties that Generated Content will be free from intellectual property claims

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Any third-party intellectual property claims arising from Generated Content
• Any content generated that is similar to or conflicts with existing works

Our total liability to you for any claims under these Terms shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Storybook Sanctum and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• User Content you submit, including photographs of yourself or others
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any claim that your use of Generated Content infringes a third party's rights

11. Third-Party Services

11.1 AI Providers

Storybook Sanctum uses Anthropic Claude (for text and story generation) and Google Gemini image generation APIs (for illustrations) to produce content. By using our Service, you acknowledge:

• Your prompts and uploaded images may be transmitted to Anthropic and Google for processing in accordance with their respective terms and privacy policies
• Depending on the service tier and provider, your inputs and the resulting outputs may be retained by these providers for a limited period and, in some cases, reviewed by their personnel for safety, quality, and policy-enforcement purposes, as described in their policies
• The behavior, outputs, and availability of AI Systems are beyond our control
• AI Systems may independently refuse, filter, or modify generation requests
• Questions about AI training data, model bias, or underlying model behavior should be directed to the respective AI providers

11.2 Payments and Fulfillment

We rely on additional third-party providers to operate the Service, and your use of the Service is also subject to their terms where applicable:

• Stripe processes all payments. Your payment card details are provided directly to Stripe and are governed by Stripe's terms and privacy policy.
• Lulu Press, Inc. manufactures and ships printed books. When you order a printed book, your shipping and contact details are shared with Lulu to fulfill that order, subject to Lulu's terms and privacy policy.
• We use cloud infrastructure and storage providers (including Cloudflare and Supabase) and an email delivery provider to host the Service, store your content and account data, and send transactional emails.

The availability and performance of these third-party services are beyond our control, and we are not liable for their acts, omissions, or service interruptions.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms or our Acceptable Use Policy
• Submission of prohibited content
• Fraudulent, abusive, or illegal activity
• Chargeback abuse

Termination does not entitle you to a refund of any completed purchases.

13. Changes to These Terms

We may update these Terms at any time. We will indicate the date of last revision at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved by binding arbitration in Memphis, Tennessee, except that either party may seek injunctive relief in court for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
